Your Right to Property Under the European Convention on Human Rights (ECHR)
Activly under investigation by The Joe Blogs Show, with the intent to correct a significant injustice, is the process by which the British Government transferred mortgage accounts to Landmark Mortgages. And the violation of people’s Human Rights.
Protocol no. 1, Article 1: Protection of Property
Every natural or legal person is entitled to the peaceful enjoyment of his possessions. No one shall be deprived of his possessions except in the public interest and subject to the conditions provided for by law and by the general principles of international law.
The preceding provisions shall not, however, in any way impair the right of a State to enforce such laws as it deems necessary to control the use of property in accordance with the general interest or to secure the payment of taxes or other contributions or penalties.
Your Protection
- You have a right to enjoy your home and property peacefully.
- That includes your house, your mortgage, your money, and any possessions.
- This applies to individuals and businesses alike.
What Governments (and Institutions acting like them) Can't Do
They can’t just take your home or property without a legal reason.
If they do take it, it must be:
- Lawful
- In the public interest
- Proportionate
- Respecting your rights
Governments are allowed to regulate how you use your property — like for taxes, planning, or safety. But those regulations must not go too far. They must strike a fair balance. If you’re being crushed by interest rates or facing eviction while you've done nothing wrong — that balance may have been broken.
How this Applies to Mortgage Prisoners and High Rates
If you:
- Have a mortgage you’ve paid reliably for years.
- Can no longer afford it because the interest rate has become unaffordable (like 9%+).
- Can’t switch lenders because you’re in a closed-book mortgage.
- Are being threatened with repossession despite no wrongdoing on your part.
Then the interference with your right to property may be:
- Disproportionate
- Unfairly restrictive
- Potentially unlawful under the ECHR
Include Protocol number 1, Article 1, of the Convention for the Protection of Human Rights and Fundamental Freedoms in any legal letters or complaints.
Raise your case with:
- The Financial Ombudsman
- The Financial Conduct Authority (FCA)
- Your local Member of Parliament
- The Equality and Human Rights Commission (EHRC)
Show that this isn’t just a financial issue — it’s a human rights issue.
