Stand Up for Your Rights
It’s easy to feel like life’s working against you or that you simply had bad timing when making a decision. But there’s always something you can do. Here are four letters you can send to help you push back and take a step towards putting things right.
Letter 1: Human Rights & Your Mortgage
This letter invokes your rights under Article 1 of Protocol 1 of the Human Rights Act — the right to peaceful enjoyment of your property. If you’re being charged unaffordable interest rates or treated unfairly by a closed-book lender, you have the right to demand an explanation. This letter asks the lender how they are applying this right in your case — and insists on a proper response.
Letter 2: Standard GDPR Request
This is a General Data Protection Regulation (UK GDPR) request for anyone who wants to know how their personal data is being stored, used, or shared. Every company that holds your data has a legal duty to respond within one calendar month.
Letter 3: GDPR Request for Mortgage Transfers
Use this version if your mortgage has been sold or transferred to another company (e.g. from Northern Rock to Landmark, or Landmark to Bloom). It asks for all data relating to your account, including internal decisions, communications, and sale documents.
Letter 4: Complaint to the ICO
If a company ignores or delays your GDPR request, you have the right to escalate your complaint to the Information Commissioner’s Office (ICO). This letter helps you do exactly that.
You have every right to understand who holds your data, how it’s being used, and whether it’s been passed on to third parties. You also have the right to enjoy your own home without unfair interference from corporate lenders.

A mortgage account is not just a financial arrangement — it is intrinsically connected to a person’s home, their stability, and their future. Actions taken by your company that result in unaffordable interest rates, the withdrawal of support, or a refusal to offer fair terms may represent an interference with this right — particularly where the borrower is left in financial distress or under threat of repossession.
Given that you now hold my mortgage as a closed book lender, with no option to remortgage with you or negotiate new terms, I am asking you to clearly explain the following:
How does your organisation actively consider and apply the principles of Article 1 of Protocol 1 in the management of closed book mortgage accounts such as mine?
What measures or policies are in place to ensure that customers are not deprived of their right to enjoy their home, or subjected to unjustifiable economic harm through excessive interest rates or inflexible terms?
What internal guidance, legal advice, or oversight exists to ensure that your conduct is consistent with the UK’s human rights obligations?
This is not a rhetorical request. I am entitled to a full and substantive response under the principles of transparency and fairness, and I ask that you treat this as a formal enquiry to be answered within 28 days of receipt.
